Liability of Pub Operators for Fake ID Use
Pub operators in the UK are expected to perform due diligence to prevent underage sales by verifying IDs, including using ID scanning technology and adopting policies like Challenge 25.
Although they cannot seize fake IDs, they can ask for them to be handed over and must ensure staff are trained to spot fakes.
The possession and use of a fake ID or an ID belonging to someone else is a fraudulent offence under Identity Documents Act 2010.
This includes passports, travel ID cards and driving licences.
The Home Office told The Morning Advertiser (The MA) that licensed premises were expected to undertake reasonable due diligence to prevent underage sales, including thorough ID checks.
